Oversight Systems Corporate Fraud Survey Finds Sarbanes-Oxley Effective in Identifying Financial Statement Fraud

Oversight Systems Inc. today announced the findings of the 2005 Oversight Systems Report on Corporate Fraud, a survey of certified fraud examiners. The report explains that most fraud examiners view Sarbanes-Oxley (SOX) as an effective tool in fraud identification, though few think it will change the culture of business leaders.

Oversight Systems Inc. today announced the findings of the 2005 Oversight Systems Report on Corporate Fraud, a survey of certified fraud examiners. The report explains that most fraud examiners view Sarbanes-Oxley (SOX) as an effective tool in fraud identification, though few think it will change the culture of business leaders.

The survey results (available as a free download at www. oversightsystems. com/survey (http://www. oversightsystems. com/survey)) indicate that 65 percent of respondents feel SOX has been “somewhat effective” or “very effective” in identifying incidences of financial-statement fraud. Only 19 percent of those surveyed found SOX to be ineffective or serve to prevent fraud identification.

“This report is full of positive news but foreshadows a real need for continued vigilance among executives toward intuitional fraud,” said Patrick Taylor, CEO of Oversight Systems. “SOX legislation and the intense focus on corporate scandals have helped battle this type of white-collar crime, but professionals seem to be worried that the C-suite might quickly lose interest in policing corporate fraud.”

Although respondents agree that SOX serves to identify fraudulent activity, they do not feel the recent cultural change among U. S. business leaders toward institutional integrity and fraud prevention in the wake of account scandals will stick. Only 17 percent feel there will be a shift among business leaders to institutional integrity and fraud prevention for the foreseeable future. The remainder of respondents possess a more stark outlook, reporting that interest in such actions will fade in the next five years (39 percent); that vigilance has already begun to fade (32 percent); or that there has been no change among business leaders (12 percent).

“The pendulum of corporate culture and attitudes toward integrity swings back and forth,” said Dana Hermanson, Dinos Eminent Scholar Chair of Private Enterprise at Kennesaw State University. Hermanson is also an advisor to Oversight Systems and co-author of the COSO-sponsored research report Fraudulent Financial Reporting: 1987-1997. An analysis of U. S. Public Companies. “We could see very little corporate fraud in the next seven or eight years, but then another boom-and-bust economic period could ignite another wave of financial scandals, which would lead to further accounting and governance reforms.”

The State of Institutional Fraud

While corporate vigilance toward fraud prevention has increased at least temporarily, fraud examiners said fraud is a bigger problem today than in the bubble market of 2000. Two-thirds of respondents (67 percent) said institutional fraud is more prevalent today than five years ago. Only seven percent think fraud is less prevalent, while the remaining 26 percent of respondents feel there has been no change in the amount of fraud.

Participants were asked to select the three forms of institutional fraud that present the greatest risk to companies. Respondents identified conflicts of interest (63 percent), fraudulent financial statements (57 percent) and billing schemes (31 percent) as most threatening. Examples of fraud that garnered at least 20 percent support were expense and reimbursement schemes (29 percent), bribery/economic extortion (25 percent) and inventory and non-cash asset misuse (20 percent)

“The risk of financial statement fraud is real and not going away,” Hermanson said. “However, the perception of increased fraud may stem from Sarbanes-Oxley’s effectiveness in uncovering weaknesses in internal controls and the potential for fraud. SOX compliance gives auditors and executives a better position to evaluate a company’s financial reporting system. Instead of only inspecting the outcome, financial reports, SOX forces companies to understand the financial reporting process as well. And like the manufacturing quality movement of the past, SOX pushes companies toward monitoring each step in the process to drive out errors and weaknesses.”

Stopping Institutional Fraud

When asked to identify the measure most effective in preventing or deterrent institutional fraud, 41 percent of professional fraud examiners identified the need for a strong tone from the top of the organization. Visible prosecution was the next most popular response garnering 22 percent support, followed by internal controls and technology-enabled monitoring, each receiving support from 17 percent. Manual quarterly audits and government regulation received only minimal support, earning two and one percent, respectively.

However, when asked what single change would result in the greatest reduction of domestic institutional fraud, opinions were more mixed. An employer pressing charges against employees who commit fraud garnered the most support with 39 percent. The trend of prosecution continued with 32 percent of respondents identifying convictions and hefty sentencing as the next most popular response. Moreover, an additional seven percent would like stiffer laws to increase corporate transparency.

“Stiff penalties and thorough prosecution send a strong message to employees. First, employees are less likely to go along with rogue executives who orchestrate financial reporting schemes. Second, a company’s prosecution of fraudulent employees establishes the corporate attitude that fraud will not be tolerated,” Hermanson said.

The Role and Views of Fraud Examiners

Survey participants report that SOX has altered the role of fraud examiners. Nearly all participants (95 percent) explain that their duties have changed with the implementation of SOX legislation, with 47 percent reporting that fraud examiners play a major role in the management of corporate integrity. Additionally, nearly one-third (29 percent) of respondents felt their work in fraud detection has become secondary to SOX compliance.

In recent years it seems white-collar crime has been a staple of the evening news. Enron, WorldCom and Martha are just a few of the high-profile names with which Americans have become all too familiar. When asked, the majority of professional fraud experts felt these well-known defendants should have been found guilty of the charges against them. The percentage of respondents who thought the following executives are guilty of the charges against them is listed below:

Identity Theft Update

Identity theft is one of the more prevalent forms of fraud known by the average American. A February 2005 Federal Trade Commission report states that for the year 2004, the commission received more than 635,000 reports of consumer fraud and identity theft, with identity theft accounting for 246,570 of the complaints (39 percent).

The 2005 Oversight Systems Report on Corporate Fraud reveals that 22 percent of respondents think the justice system must get tougher on the identification and prosecution of identity thieves. Additionally, 19 percent believe that the federal government needs to pass national identity-theft-protection legislation and another 19 percent feel regulators and consumers must work together to manage consumer information.

Some respondents believe that individuals are the first and most important line of defense. Taking ownership of one’s own personal information was identified by 16 percent of respondents as the best way to reduce identity theft.

A total of 208 certified fraud examiners participated in this survey, conducted at the Association of Certified Fraud Examiners’ (ACFE) 16th Annual Fraud Conference and Exhibition. The America-Israel Cultural Foundation (AICF) is experiencing a crisis due to investments believed to be with Bernard Madoff and Bernard Madoff Securities, LLC. THE IMPERSONATION GAME

“Can machines be?” Can they be, for all intents and purposes, a specific human individual?

Alan Turing, in his 1950 paper, asked “Can machines think?”, and proposed the Imitation Game, testing machine against human in ability to converse. Turing wrote, “...the odds are weighted too heavily against the machine.” In a new paper, Rollo Carpenter of Jabberwacky and Jonathan Freeman of i2 media research propose to weigh those odds more heavily still. We propose an Impersonation Game, and a "Personal Turing Test", in which the machine must convince that it is a known human individual.

The new Game will be played, like the old, with a human, a machine and a remote interrogator. The human must be known to the interrogator, and the machine must impersonate that human. The interrogator may be remotely present via the web in a way that Turing is unlikely to have foreseen.

The Impersonation Game is not limited to text, involving a level of technological presence representation that best supports the goal. The interface could be audiovisual, though the test may be passed without. It could use other subtle social communication cues, both those of face-to-face communication like gaze or expression, and representations of near-imperceptible information such as a ‘person’s’ emotional internal and physiological states.

To what degree should the human and the interrogator know each other? Should they have recently met, have known each other as colleagues, or socially? Should they be friends and family? To overcome the unknowable degree of knowing, in order to pass the Personal Turing Test, a machine will play 100 Impersonation Games as 100 different people, known to the interrogators to every different degree, and will win 50% or more.

CHATBOTS & JABBERWACKY

Hundreds of software programs talk daily with the public over the web, and the term ‘chatbot’ has been coined. Most such programs are variations on the work of a few originators, downloaded and edited. It is impossible for programmers to codify the infinity of language, and responses often take the form of avoidance and diversion. This is “light conversation”, in which, at a surface level, responses make sense, yet are difficult to confuse with human life.

A possible exception is the Artificial Intelligence technology behind Jabberwacky. com. Despite clear descriptions, some visitors become convinced that they are talking to volunteers or other visitors - that there is no machine. This AI is different because it has learnt to talk by talking, from scratch, in any language, using the context of complete conversations. When you chat, it learns what you say and when, and may use your words on someone else. ItÂ’s a positive feedback loop - an imitator of humanity at large.

Jabberwacky has a database of 5 million full sentences, which are replayed verbatim when selected. This huge simplification of language was chosen for performance, and to demonstrate the power of context, and its relationship to human learning. It doesn't always make sense, especially in its current entertainment-centric guise. It can be illogical, inconsistent, contradictory, or plain silly - still too often ‘unexpected’ regularly to pass the Turing Test. Yet that very unexpectedness is a spark of the chaotic that we humans all possess.

We believe that with 10 million entries, Jabberwacky will pass as human most of the time for most people. If given the serving power of search engines, with billions of entries, it would become a new mode of human entertainment and communication.

PERSONALISATION

The AI that powers Jabberwacky is becoming an impersonator of individuals. People can teach it their name, age, sex, location, work, interests, favourite topics, languages, and word usage patterns. One may choose to talk to ‘people’ that meet any criteria of choice or to any individual that allows themselves to be ‘published’.

The AI will take the Personal Turing Test. Passing it will be a considerably greater challenge. 10 million entries would take one person a lifetime, but fortunately, humans are predictable. When selecting what to say, the AI will favour the teaching of the individual, dropping back as necessary to things said by those most similar. Around 200,000 responses will needed - the far more manageable work of about one year.

NEW DOMAINS

A key feature of AI is the predictive power of experience. As Jabberwacky can learn how people in general, and particular people, respond verbally, a similar algorithm will learn how individuals ‘are’; verbally and non-verbally.

This raises the exciting, if not disruptive, prospect of multiple, convincing, distributed selves, and the manifold applications such technological innovation promises - from satisfying remote communications, to partner vetting, to salespeople 'being with' many clients at once. The prize for the developers of the machines that will pass the Personal Turing Test is clear.

FUTURE CONCLUSION

In 1950 Alan Turing predicted that Imitation Game would be won within 50 years. The year 2000 has sailed by, yet we believe that the Turing Test will be passed by 2015, and that contextual learning techniques are those most likely to succeed.

So... “Can machines think?” The machines that pass will not actually think, but will be superb imitators that have borrowed the interaction skills of millions of people, and achieved sufficiently high-fidelity playback. Yet a non-human form of understanding of language will have emerged. Believably 'human' machine communicators will entertain, accompany, educate and assist.

The Personal Turing Test is much more challenging, yet an accelerating pace of technological change will deliver a pass within 20 years, by 2025, with profound implications for our futures: our privacy, communication, education, work and location. It may even be a step towards a virtual life extension.

So, again... “Can machines be?” If a machine can pass the Personal Turing Test, it can, too, be an individual in its own right. As we understand it, it won't ‘think’ or have ‘emotions’, yet it will appear so, and be complex beyond analysis, as is a brain.

Medicare Oklahoma, a group advocating education on new prescription drug benefits for seniors, today launched a campaign to educate Oklahoma senior citizens on Medicare “Part D” prescription drug coverage. The group was formed to help Oklahomans take full advantage of an enhanced Medicare program by providing the information needed to make educated decisions that could impact their health.

“Trying to understand Medicare benefits is confusing,” said Renzi Stone, statewide spokesman for Medicare Oklahoma. “With the launch of ‘Part D’ it is more important than ever those seniors have knowledge of how to accept benefits in Oklahoma. Beginning October 1st, seniors will be deluged with competing information regarding prescription drug benefits for Medicare recipients.

As part of a grassroots effort, Medicare Oklahoma will be traveling across central Oklahoma holding informal community meetings to present detailed information in an easy to understand format from CMS, the operating Government body for Medicare. Following education sessions, Medicare Oklahoma personnel will answer questions from participants. The first meeting will be on October 11 from 5 p. m. to 7 p. m. at Mayfair Baptist Church in Oklahoma City.

According to Stone, many of the groupÂ’s presenters and organizers are senior citizens who understand the need for education on the issue and can relate on a personal level to those affected by the changes to the Medicare program.

“As a group formed with the expressed purpose of educating, we are working to make sure our elders fully understand how changes in Medicare will affect them and offer every opportunity to help them make the right decisions for their unique circumstances,” said Stone. “‘Part D’ benefits will provide great coverage for Oklahoma seniors at a reasonable cost.”

Medicare Oklahoma is promoting four facts every Medicare eligible senior should know:

•People on Medicare can begin enrolling for prescription drug coverage as early as November 15

•Approximately one-third of people with Medicare will qualify for extra prescription support

•If seniors already receive good drug coverage from their employer or union, Medicare can help keep that coverage secure

•Everyone with Medicare must make a decision about their drug coverage before May 15; delayed enrollment will result in a penalty fee

Our desire is to establish a campus of excellence…" Most notably, since 2008, female enrollment in ATVI's vocational program increased from 11% in its first class to nearly 30% in the 2009 class and is anticipated to reach 50% by 2011. AIS's Report on Medicare Compliance (RMC) - Brand-name drug makers that follow their trade group's updated voluntary code for interacting with providers will no longer distribute freebies such as pens and coffee mugs. Companies also should not be buying meals for providers without offering product education at the same time, the Pharmaceutical Research and Manufacturers of America (PhRMA) says in its recently released "PhRMA Code on Interactions with Healthcare Professionals". While the changes should have been expected by health care entities and physicians, older doctors may have more trouble adjusting, two experts tell AIS's Report on Medicare Compliance.

This version of the code is updated from one released in 2002 and takes effect in January 2009. PhRMA says this is an ongoing process. Companies that publicly say they will follow the code will be listed on PhRMA's Web site and will have to certify annually that they have policies and procedures in place to foster compliance with the code, the organization says.

"Providing items for healthcare professionals' use that do not advance disease or treatment education - even if they are practice-related items of minimal value (such as pens, note pads, mugs and similar 'reminder' items with company or product logos) - may foster misperceptions that company interactions with health care professionals are not based on informing them about medical and scientific issues," the organization says. But educational items, such as anatomical models for exam rooms, are still OK a long as they cost less than $100, according to the code.

PhRMA says companies can still buy meals for providers, but they must be "modest," "occasional" and must take place in the office or hospital setting and should accompany an informational presentation. Entertainment tickets are out now too.

PhRMA also says arrangements under which health care professionals work as consultants should be handled with care. "It is appropriate for consultants who provide advisory services to be offered reasonable compensation for those services and reimbursement for reasonable travel, lodging, and meal expenses incurred as part of providing those services. Any compensation or reimbursement made in conjunction with a consulting arrangement should be reasonable and based on fair-market value," the code says.

Across the U. S., architects are putting their skills and talents to work for the public good, according to a recent survey of 150 firms (http://www. theonepercent. org/pg. cfm? nid=326) by nonprofit Public Architecture.

"There has never been a survey focused specifically on pro bono service by architecture firms or even individual architects before," says John Cary, Public Architecture's executive director.

The survey sample ranged from sole practitioners to some of the largest firms in the country, such as HKS and Perkins Will, all of which have pledged a minimum of 1% of their billable hours to pro bono service via Public Architecture's flagship "1% Solution (http://www. theonepercent. org)" program. Public Architecture's goal is to direct a minimum of 1% of every firm's time to pro bono service, and these 150 are leading the way.

Virtually every firm reported exceeding the goal of 1%, and more than two-thirds devoted 2% or more of their time to pro bono service over the past year. This level of activity is all the more significant considering that respondents overwhelmingly cited their firms' "financial constraints" and "available staff time" as the two greatest obstacles to engaging in pro bono work. "We're talking about a major investment of time and resources," Cary adds.

"This is a historic survey," according to Aaron Hurst, founder and president of the Taproot Foundation (http://www. taprootfoundation. org), which connects nonprofits with business professionals from a variety of fields on a pro bono basis. "It represents the first time, outside of the legal profession, that a quantifiable standard for pro bono has been put on the table for a specific industry and measured. Most significantly, the survey brings to light the barriers to further investment as well as demonstrated commitment to overcoming them."

As to what motivates firms to give of their time and talents, 88% of survey respondents named "social relevance" as the most important variable in choosing pro bono projects. Similarly, 73% of respondents cited "community benefit" as having the highest impact on any future efforts to increase the quality or quantity of their pro bono work. Other key selection variables included project type, design opportunity, and a personal connection with the issues addressed by projects or the client themselves.

The survey revealed that architects contributed significant time and resources over the past year alone to a wide range of projects and services, from rebuilding a storm-damaged library in New Orleans to general consulting for local nonprofits. Donated services comprised the largest type of pro bono contributions, followed by reduced-fee services, general volunteer work, and cash donations. Most respondents cited a combination of the aforementioned items.

Some firms chose to work with established nonprofits, such as Habitat for Humanity, Adopt a Room, and the Robin Hood Foundation's Library Initiative. Others have dedicated their time to projects that they conceived of and spearheaded, drafting unsolicited open space plans and sustainability strategies for their particular neighborhoods. A few even looked beyond national boundaries, helping with tsunami relief efforts in Sri Lanka or village planning in Liberia.

The results of this first annual survey strongly supported the next evolutionary step of the 1% Solution program, the national initiative through which architecture firms pledge a minimum of 1% of their billable hours to pro bono service.

The next phase of the 1% Solution program involves the creation of a national database and online clearinghouse to match architects with nonprofit organizations and other appropriate pro bono clients in need of their help. The new online database, paired with the release of a first-of-its-kind print publication on pro bono design, is expected to go online in September.

"This is a breakthrough moment for pro bono design and also our 1% Solution program," says Cary. "We are on the brink of mobilizing architects and bringing professional design to communities in need at a scale never seen before."

Despite the myth, you CAN get lung cancer even if you never smoked. Lung cancer kills more people than any other type of cancer. Lung cancer claims more lives than breast cancer, prostate cancer, colon cancer, liver cancer, melanoma, and kidney cancer combined. Consider this: 173,000 people are diagnosed with lung cancer annually. Three per minute. 165,000 people died of lung cancer last year. 650,000 lives will be lost by 2010 if early detection does not become a national priority.

Founder Bonnie Addario is a two-and-a-half year lung cancer survivor. Through what she calls “serendipity and divine intervention” and the help of great doctors at CHW Sequoia Hospital and UCSF’s Thoracic Oncology Program headed up by Dr. David Jablons, she is one of the lucky few who has survived. “I live every single minute of every single day thinking about how we can catch this disease early, so nobody, not anybody in my family, or any of my friends or anyone I haven’t yet met has to go through the pain and suffering that I did and may still. I will always have cancer. But I am one of the lucky ones, who beat the odds, for now," Addario said.

She began her Foundation on March 6, 2006, the very same day Dana Reeve, a nonsmoker, passed away. According to Bonnie, “Until now lung cancer has taken a back seat to every other deadly cancer. It is time for lung cancer to matter, too. Screening for lung cancer is available, but ignored. We are going to change that in every hospital across the country.”

Co-chair U. S. Senator Chuck Hagel, is being honored at the event for his groundbreaking work in achieving unanimous approval for Senate Resolution 408 calling on President Bush to declare lung cancer a national health priority. He will receive the “Luminosity Award.” Other honorees include CHW Sequoia Hospital’s Dr. Fred Marcus and UCSF’s Dr. T hierry Jahan, researcher Xidong Xu, and survivor Rebecca Broder among others. Last year’s Lungevity 2005 had a surprise guest: Robin Williams opening the event with a video introduction. More surprise visitors are in store for this year’s attendees.

Thirty-nine percent of the Inc. 500 are now blogging, a 20 percent increase in just one year according to a new research study, "Social Media in the Inc. 500." The study was conducted by Dr. Nora Ganim Barnes, Ph. D., Chancellor Professor of Marketing at the University of Massachusetts Dartmouth and Senior Fellow of the Society for New Communications Research and Eric Mattson, CEO of Financial Insite Inc., a Seattle-based research firm.

Nine percent of the Inc. 500 are now blogging, a 20 percent increase in just one year according to a new research study, "Social Media in the Inc. 500." The study was conducted by Dr. Nora Ganim Barnes, Ph. D., Chancellor Professor of Marketing at the University of Massachusetts Dartmouth and Senior Fellow of the Society for New Communications Research and Eric Mattson, CEO of Financial Insite Inc., a Seattle-based research firm.

The study represents the first statistically significant, longitudinal study on the usage of social media by corporations. For the first time, growth in familiarity, adoption and importance to mission has been documented. The new study compares corporate adoption of social media between 2007 and 2008 by the Inc. 500, a list of the fastest-growing private U. S. companies compiled annually by Inc. Magazine. This study revisits the Inc. 500 approximately one year later (using the 2007 list) in the first longitudinal study on corporate use of these new technologies.

In 2007 (using the 2006 Inc. 500 list), the first study of this group and their use of social media was released and revealed that the Inc. 500 was outpacing the more traditional Fortune 500 in their use of social media. For example, at that time, 8% of the Fortune 500 companies were blogging compared to 19% of the Inc. 500.

Questions explored familiarity and adoption of six social media types: blogging, podcasting, online video, social networking and wikis.

Key Findings include:
 From familiarity to usage to importance, social media is expanding rapidly within the Inc. 500. The adoption rate of social media by Fortune 500 companies pales in comparison to that of Inc. 500 companies over the same time period.  All six forms of social media have enjoyed growth in the adoption of these tools with 77% of the Inc. 500 reporting use of at least some social media tool.  The social media type that continues to be the most familiar to the Inc. 500 is social networking, with 57% of respondents in 2008 claiming to be "very familiar with it" (compared to 42% in 2007).  In 2007 just over one quarter of the Inc. 500 reported that social media was "very important" to their business/marketing strategy. That number has increased to 44% just one year later.

"Not only is this widespread adoption being driven by strong familiarity with social media, but also from recognizing the critical role of social media to a company's future success in today's online world," noted Barnes. "It's clear that this group of fast-growing companies considers the use of social media a central part of their strategic plans."

"If the Inc. 500 is embracing social media at this record pace, can the rest of corporate America be far behind," added Mattson.
